GOLDEN-VISA FOR OUTSIDE-SCHENGEN

Portugal has one of the most appealing situations in Europe for attracting real estate investment through the Golden Visa process.

Even though there are main countries to take advantage of the conditions of the Golden Visa (China, Russia, Brazil and Angola), this possibility has been taken by over than 29 different nationalities. Most of these visas are related to the purchase of a property for residential purposes.

The rules governing the granting of Residence Permit for Investment (ARI / Golden Visa), in force from 8 October 2012, enable third country nationals to obtain a temporary residence permit to conduct business activities with visa waiver to enter national territory. The beneficiaries of ARI / Golden Visa are entitled to:

Residence visa waiver for entering Portugal;
Living and working in Portugal, on condition that they stay in Portugal for a period of 7 or more days, in the first year, and 14 or more days, in the subsequent years;
Visa exemption for travelling within the Schengen Area;
Family reunification;
Applying for permanent residence (pursuant to the Aliens Act – Act number 23/2007 of 4 July with the current wording );
Applying for Portuguese citizenship, by naturalization, provided all other requirements set out by the Nationality Act are fulfilled  (Act number 37/81 of 3 October, with the current wording);

Eligibility – Who may apply? 

All third country citizens who conduct an investment activity, as an individual businessperson or through a company set up in Portugal or in another EU Member State and who, in addition, are stably settled in Portugal, provided these citizens fulfil the quantitative requirements and the time requirements set out by the relevant legislation, may apply for a Residence Permit for Investment, by one of the following routes:

i. Capital transfer with a value equal to or above 1 million Euros;

ii. The creation of, at least, 10 job positions;

iii. The purchase of real estate property with a value equal to or above 500 thousand Euros;

iv. The purchase of real estate property, with construction dating back more than 30 years or located in urban regeneration areas, for refurbishing, for a total value equal to or above 350 thousand Euros;

v. Capital transfer with a value equal to or above 350 thousand Euros for investing  in research activities conducted by public or private scientific research institutions involved in the national scientific or technologic system;

vi. Capital transfer with a value equal to or above 250 thousand Euros for investing  in artistic output or supporting the arts, for reconstruction or refurbishment of the national heritage, through the local and central authorities, public institutions, public corporate sector, public foundations, private foundations of public interest,  networked local authorities, local corporate sector organizations, local associations and public cultural associations, pursuing activities of artistic output, and reconstruction or maintenance of the national heritage;

vii. Capital transfer with a value equal to or above 500 thousand Euros, for purchasing shares in investment funds or in venture capital geared to capitalize small and medium companies that, in turn, must present a feasible capitalization plan.

In the legal frame, the revision of the Urban Rehabilitation regime and more recently the implementation of the Golden Visa program are factors which have contributed for an inversion of the cycle in the real-estate market. 

The Golden Visa program, which initially introduced a new dynamic in the residential segment, has been more recently attracting other investors, including institutional investors. This new legislative frame which is oriented to the revitalization if the city, and the boost of the renting market, attracting foreign investment, became an investment opportunity, which associated or not with the Golden Visa status, have improved the development of the market for the properties for re-sale, becoming actives for income, and also, actives for touristic exploration.

In the base of this program lies a legislation with clear goals, easy to understand for all economical agents, and of simple implementation, what has been key to its success and is a case study for other economical areas. The governmental effort in placing together different players of one sector is an important strategy, and legislatively, the conditions in which this program work, such as the possibility of increase of the deadline that the investor has to complete the legal purchase of the property.

Golden Visa

Accordingly to published data, until march 2014, 727 Golden Visas had been issued, representing a total of 441 million euros invested, coming from 29 different nationalities, but mostly from China (590), Russia, (26), Brazil (19) and Angola (16). Approximately 400 millions (689 visas), are related to the purchase of real-estate property, its majority destined for living. Accordingly to the Ministry of Foreign Affairs, the priority markets, for which there is a reinforcement of the visa attribution services, are China, India, Russia, United Arab Emirates and Colombia.

Accordingly to the legislation of the ARI (Golden Visas), this represents a mechanism for attracting foreign investment in Portugal, which issues an authorization of residence in the country, for a period of five years, to those who fulfil the investment operations established by law, which in what concerns the real-estate area, represents the purchase of real-estate property in an amount equal or above 500 thousand euros, which is the most commonly chosen alternative by non-European citizens.

This program is not exclusive from Portugal, existing for many years in the UK, Malta, Latvia and Switzerland. Since 2012, along with Portugal, other countries have seized this opportunity to capture direct foreign investment, namely Ireland, Cyprus, and more recently Spain and Greece. Malta has approved the issuing of the second passport (nationality), in an immediate way, in return for investment in the country, a measure which has created some level of polemics in the EU, being considered by some as a “sale” of nationality.

The Spanish program is similar to the Portuguese one, although the amounts are the same, it only allows for the possibility of nationality after 10 years, which is a disadvantage in comparison to the Portuguese regime. However, there is no minimum stay in the country. The Greek program requires a minimum investment in real-estate property of only 250 thousand euros.

• Entrar em Portugal sem visto de residência;

• Residir e trabalhar em Portugal. Para tal, têm, no primeiro ano de permanecer em Portugal por um mínimo de 7 dias, e nos anos seguintes um mínimo de 14;

• Circular pelo espaço Schengen sem necessitarem de visto;

• Beneficiar de reagrupamento familiar;

• Solicitar a concessão de Autorização de Residência Permanente nos termos da Lei de Estrangeiros (Lei n.º23/2007, de 4 julho, com a atual redação);

• Solicitar a nacionalidade portuguesa, por naturalização, cumprindo os requisitos exigidos na Lei da Nacionalidade (Lei n.º37/81, de 3 outubro, com a atual redação).  

Os cidadãos de Estados Terceiros que exerçam atividade de investimento pessoalmente ou através de uma sociedade constituída em Portugal ou noutro País da U.E. e com estabelecimento estável em Portugal, que cumpram com um dos requisitos quantitativos e o requisito temporal previstos na legislação, podem solicitar Autorização de Residência para Atividade de Investimento, investindo numa das seguintes possibilidades:

a) Transferência de capital num montante igual ou superior a um milhão de euros;

b) Criação de pelo menos 10 postos de trabalho em Portugal;

c) Aquisição de bens imóveis de valor igual ou superior a 500 mil euros;

d) Aquisição de bens imóveis, cuja construção tenha sido concluída há, pelo menos, 30 anos ou localizados em área de reabilitação urbana e realização de obras de reabilitação dos bens imóveis adquiridos, no montante global igual ou superior a 350 mil euros;

d) Transferência de capital num montante igual ou superior a 350 mil euros, aplicado em atividades de investigação desenvolvidas por instituições públicas ou privadas de investigação científica, integradas no sistema científico e tecnológico nacional;

e) Transferência de capital num montante igual ou superior a 250 mil euros, aplicado em investimento ou apoio à produção artística, recuperação ou manutenção do património cultural nacional (...);

f) Transferência de capital num montante igual ou superior a 500 mil euros, destinados à aquisição de unidades de participação em fundos de investimento ou de capital de risco vocacionados para a capitalização de pequenas e médias empresas que, para esse efeito, apresentem o respetivo plano de capitalização e o mesmo se demonstre viável.

Neste quadro, a entrada em vigor do NRAU, a revisão do regime de Reabilitação Urbana e a implementação do programa de ARI - Golden Visa, contribuíram muito positivamente para uma inversão da tendência no mercado imobiliário.

Os Golden Visa, no seu inicio criaram uma dinâmica positiva no segmento residencial, sendo que mais recentemente, esta legislação tem sido orientado para a reabilitação e revitalização das cidades, dinamizando também o mercado de arrendamento e de revenda.

Até Março de 2014 (apenas dois anos após a entrada em vigor do regime ARI) foram atribuídos mais de 700 vistos, representando aproximadamente 440 milhões. Estes vistos foram concedidos a 29 nacionalidades diferentes, principalmente da China (590), Rússia (26), Brasil (19) e Angola (16). Aproximadamente 400 milhões do valor global diz respeito à compra de ativos imobiliários. Atualmente, o número de vistos cifra-se em mais de 3 mil, dos quais 90% foram concedidos a cidadãos chineses.

Os Golden Visas são um mecanismo de atração de investimento estrangeiro para Portugal, permitindo a autorização de residência no país, por um período de cinco anos, a quem realize em Portugal uma das tipologias de investimento previstas na lei, como referido anteriormente. A compra de ativos imobiliários num valor igual ou superior a 500 mil euros tem sido a mais popular escolha.

Este programa não existe exclusivamente em Portugal. Reino Unido, Malta, Letónia e Suíça são países que começaram com esta tendência antes de Portugal. Desde 2012, a par com Portugal, outros países abriram esta possibilidade de investimento como é o caso da Irlanda, Chipre e, mais recentemente, Espanha e Grécia.

O “Golden Visa” Espanhol é similar ao Português, especificamente no que diz respeito ao montante mínimo de investimento em ativos imobiliários, mas apenas possibilita a nacionalidade espanhola ao fim de 10 anos, o que é uma desvantagem se considerarmos o regime Português. Na Grécia é exigido um investimento inferior, de 250 mil Euros em ativos imobiliários.
